Chapter two: WuqÅ«f at ‘Arafāt


It is the second obligation of hajj. ‘Arafāt is a known mountain, the boundaries of which are from the inside of `Urnah, Thuwayyah and Nimrah to Dhi'l-Majaz, and from Ma'zamain to the extreme limit of the wuqÅ«f area. These limits are considered outside the area of ‘Arafāt.
Issue 330. WuqÅ«f at ‘Arafāt is a worship for which intention is obligatory with its conditions mentioned for that of ihÌ£rām.

Issue 331. What is meant by wuqūf is the general meaning of attendance at that place no matter whether one is riding, walking or standing.
Issue 332. It is based on caution to stay there from shar‘Ä« noon of the 9th of Dhul-Hijjah until maghrib, i.e. the time of the prayer of maghrib. It is not remote that it is permissible to delay the wuqÅ«f a little bit after shar‘Ä« noon for a time just enough for the performance of prayer of zuhr and ‘asÌ£r together with their preliminaries.
Issue 333. The mentioned wuqūf is obligatory; however, the rukn of it is just the strict meaning of staying even for 1-2 minutes. So if a person under normal conditions neglects this strict meaning of staying, his / her hajj is void, and if one does it only and neglects the remainder or delays wuqūf until afternoon, his / her hajj would be correct, although he /s he would commit a sin if he / she does that purposely.
Issue 334. It is hÌ£arām to stream out from ‘Arafāt before maghrib. So if a person doe sthat intentionally, gets out of its limits and does not return, he / she is considered as a disobedient and is obliged to do kaffārah with a camel. Nevertheless, his / her hajj is correct. If one can not slaughter a camel, he / she should fast for 18 days. It is based on caution to slaughter the camel on the day of ‘Ä«d at Minā although it is not remote that being in Minā is not determined. If one returns to ‘Arafāt before maghrib , there would be no need for kaffārah.
Issue 335. If one, forgetfully or ignorantly, streams out from ‘Arafāt before maghrib, he / she is obliged to return if he / she noticed this before the time is over. If one does not return, he / she would have disobeyed, although there is no kaffārah on him / her. While if one does not notice this until the time is over, then there would be nothing on him.
